Welcome to Lumira ("Lumira," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of the Lumira website, mobile application, and related services (collectively, the "Services").

By accessing or using Lumira, you agree to these Terms. If you do not agree, please do not use the Servies.

1. Eligibility

You must be at least 18 years old to create an account or use Lumira. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If we become aware that an individual under the age of 18 has created an account or provided personal information, we reserved the right to suspend or terminate the account and delete associated information in accordance with applicable law.

2. Purpose of the Services

Lumira provides digital tools designed to support personal wellness, mindfulness, emotional awareness, mood tracking, journaling, meditation, habit building, and related educational content.

Lumira is intended for informational and self-improvement purposes only.

3. No Medical Advice

Lumira is not a healthcare provider.

Nothing in the Services constitutes:

• Medical advice

• diagnosis

• treatment

• psychotherapy

• counseling

• psychiatric care

• crisis intervention

  Any information, recommendations, summaries, insights, or AI-generated content are provided solely for general wellness purposes.

  Always consult a qualified healthcare professional regarding any medical or mental health concerns.

  Do not disregard professional medical advice because of information obtained through Lumira.

4. Emergency Situations

Lumira is not designed for emergencies.

If you believe you are experiencing a medical or mental health emergency, including thoughts of self-harm or suicide:

• Call your local emergency services immediately.

• Contact your healthcare provider.

• Contact an appropriate crisis hotline.

  Do not rely on Lumira for emergency assistance.

5. Emergency Situations

You are responsible for:

• maintaining the confidentiality of your login credentials.

• all activity occuring under your account

• providing accurate information

  Your agree to notify us immediately if you suspect unauthorized access.

6. Acceptable Use

You agree not to:

• violate any laws

• interfere with the Services

• attempt unauthorized access

• upload malicious software

• impersonate another person

• use the Services to harass or abuse others

• misuse AI features or attempt to manipulate system functionality

7. User Content

You retain ownership of any journal entries, notes, reflections, or other content you submit.

By Submitting content, you grant Lumira a limited license to store, process, and display that content solely to operate and improve the Services.

You represent that you have the rights necessary to submit your content

8. Artificial Intelligence Feature

Some Lumira features may use artificial intellegence to generate summaries, wellness suggestions, reflections, or educational content.

AI-generated content:

• may not always be accurate

• should not be considered medical advice

• may occasionally contain errors

• should be reviewed using your own judgement

You are responsible for desicions made based on AI-generated content.

9. Intellectual Property

All software, branding, logos, graphics, content, designs, and materials provided by Lumira are owned by Lumira or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or reproduce any portion of the Services without written permission.

10. Subscriptions and Payments

Certain features may require a paid subscription.

If you purchase a subscription:

• fees are charged in advance

• subscription automatically renew unless cancelled

• cancellation prevents future renewals but does not refund prior payments except where required by law.

If purchases are made through an app store, biiling is governed by that store's policies.

Your use of Lumira is also governed by our Privacy Policy.

12. Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability.

We may modify, suspend, or discontinue any feature at any time without liability.

To the fullest extent permitted by law, Lumira disclaims all warranties, inlcluding:

• merchantability

• fitness for a particular purpose

• non-infringement

• uninterrupted or error-free operation

14. Limitation of Liability

To the fullest extent permitted by law, Lumira and its owners, employees, contractors, affiliates, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Services.

Our total liability shall not exceed the amount you pad to Lumira during the previous twelve mothns.

15. Indemnification

You agree to indemnify and hold harmless Lumira from any claims, damages, liabilities, and expenses arising from:

• your misuse of the Services

• violation of these terms

• infringement of another person's rights

16. Termination

We may suspend or terminate your account at any time if you violate these Terms of misuse the Services.

You may stop using Lumira at any time.

17. Changes to These Terms

We may update these Terms periodically.

Material changes will be communicated through the Services or by other reasonable means.

Continued use after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the United States of America, without regard to conflict of law principles.
